Your agreement for using Traxcend

Welcome to Traxcend. These Terms of Service ("Terms") govern your access to and use of the Traxcend platform, website, and services (collectively, the "Platform") provided by Moving Forward Small Business ("we," "us," or "our").
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Platform.
Traxcend is a business management platform designed to help solopreneurs and small business owners track their projects, manage finances, log time and mileage, manage clients and leads, generate proposals, and access AI-powered business insights and opportunities.
We reserve the right to modify, suspend, or discontinue any part of the Platform at any time with or without notice.
To use certain features of the Platform, you must create an account. You agree to:
- •Provide accurate, current, and complete information
- •Maintain and update your information to keep it accurate
- •Maintain the security of your account credentials
- •Accept responsibility for all activities under your account
- •Notify us immediately of any unauthorized access
You must be at least 18 years old to create an account.
Plan Tiers
Traxcend offers multiple subscription plans:
- •Starter (Free): Limited features with up to 3 active projects
- •Pro: Enhanced features with AI-powered tools and up to 20 projects
- •Elite: Unlimited projects and premium integrations
Billing
- •Paid subscriptions are billed monthly or annually in advance
- •All fees are non-refundable except as required by law
- •Subscriptions automatically renew unless cancelled
- •We may change pricing with 30 days' notice
- •You are responsible for all applicable taxes
Cancellation
You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your billing period, after which your account will revert to the free plan.
You agree not to:
- •Use the Platform for any illegal or unauthorized purpose
- •Violate any applicable laws or regulations
- •Interfere with or disrupt the Platform or servers
- •Attempt to gain unauthorized access to any portion of the Platform
- •Transmit viruses, malware, or other malicious code
- •Impersonate any person or entity
- •Scrape, harvest, or collect user data without permission
- •Use the Platform to spam, harass, or harm others
- •Reverse engineer or attempt to extract source code
Our Rights
The Platform, including all content, features, functionality, software, and design, is owned by Moving Forward Small Business and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.
Your Content
You retain ownership of any data, information, or content you submit to the Platform ("Your Content"). By submitting Your Content, you grant us a limited license to use, store, and process Your Content solely to provide and improve the Platform.
You represent and warrant that you own or have the necessary rights to Your Content and that it does not violate any third-party rights.
Traxcend provides AI-powered features including business idea generation, proposal drafting, and outreach message creation. AI-generated content is provided "as is" for your consideration and should be reviewed and customized before use.
You are solely responsible for any AI-generated content you choose to use. We make no warranties about the accuracy, completeness, or suitability of AI-generated content for your specific purposes.
The Platform may contain links to third-party websites or integrate with third-party services (such as payment processors). We are not responsible for the content, privacy practices, or terms of service of any third-party services.
Your use of third-party services is at your own risk and subject to their respective terms and policies.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Platform will be uninterrupted, error-free, or secure. We do not guarantee the accuracy, completeness, or reliability of any content or data on the Platform.
Traxcend is a business management tool and does not provide financial, legal, or tax advice. Consult with qualified professionals for business decisions.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOVING FORWARD SMALL BUSINESS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Moving Forward Small Business and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or related to:
- •Your use of the Platform
- •Your violation of these Terms
- •Your violation of any third-party rights
- •Your Content
We may suspend or terminate your access to the Platform at any time, with or without cause or notice, including if you violate these Terms.
Upon termination, your right to use the Platform will immediately cease. We may delete your account and data, though we may retain certain information as required by law or for legitimate business purposes.
Provisions of these Terms that by their nature should survive termination will survive, including intellectual property rights, disclaimers, and limitations of liability.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
Arbitration
Any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration, except where prohibited by law. You waive your right to participate in a class action lawsuit or class-wide arbitration.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after changes constitutes acceptance of the new Terms.
- •Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Platform.
- •Severability: If any provision is found unenforceable, the remaining provisions will remain in effect.
- •Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
- •Assignment: You may not assign or transfer these Terms without our written consent.
